The affiant Michael Hauze states thathe is the father and agent of the Defendant John W Hauze appointed by him he being in the army his agent to attend to the defence of the prosiecution against defendant in said Court & all Matters growing out of it he further states that he knows of his own knowledge that it was out of the power of his said Son to attend at the June term Last of said Court That he was required to report to the provost Marshall at [...] J. [ct.] Who held him for transportation to his army & would not let him pass elsewhere

That after his son reported to said Marshall by the influence of this affiant & he affiant giving bond that sd Son Should When Called on report to said Marshall he suffered him to remain at home until about the first of July when he was arrested & sent to his Command That it was impossible for said defendant to get to Glasgow in June last without a pass & that said pass could not be obtained That his said son staid with affiant & was informed & affiant beleaves that with a pass there was no Probability of

of Passing on the L & N Rail Road on account of its having been or a portion of it Torn up & destroyed which he States had been done as he is informed, that his son is now or was a short time since & has been for several months in Tennor Georgiawith his command That affiant lives in the State of IndianaThat the Statements Made in this affidavit are true
