Be it remembered that at a term of the Allen Circuit Court began and held at the Court House in the County of Allen in the 10th Judicial Circuit of the State of Indiana, commencing on the
State of Indiana.

Thomas Fitzmorris
Comes now James H. Schell Esq. prosecutor of the pleas of the State in this behalf and now causes Moses Jenkinson the Attorney of said defendant and the motion for a new trial heretofore made in this behalf is by the Court overruled, to which ruling of the Court said defendant by his said Attorney excepts.
It is therefore ordered by the Court
that said defendant ^Thomas Fitzmorris^ make his bail unto the State of Indiana in the penal sum of Fifty Dollars, and that said defendant be confined in the Penitentiary of the State of Indiana, at hard labor for the time of time of four years and that the said defendant stand committed to the custody of the Sheriff of Allen County to be by him as soon as convienent conveyed to the Penitentiary of the State of Indiana, and the Sheriff of Allen County is charged with the execution of this sentence.
It is further ordered by the Court that the State of Indiana have and receive of and from said defendant his costs and charges in this behalf expended —
It is further ordered that a warrant issue forthwith for the arrest of said defendant —
