County of Kenton } SS,

Before the undersigned a justice of the peace within and for the county and commonwealth aforesaid, this day personally came Andrew J. Surface of lawful age, who being by me first duly sworn according to law on oath says, That on the nineteenth day of March Eighteen Hundred and Sixty Four at the County of Kenton in the commonwealth of Kentucky, Adam J. Surface late of said County was guilty of the crime of bigamy, in this — That he the said Adam J. Surface on the day and year aforesaid at the County and commonwealth aforesaid, was married to one Elizabeth Snyder otherwise called Lucy Elizabeth Stover, he the said Adam J. Surface then and there being a married man, and his lawful wife Sarah Surface being then alive, Affiant further deposing says, that he is personally and well acquainted with the said Adam J. Surface, that he the said Adam J. Surface was lawfully married to Sarah Irick in the County of Preble Ohio in the month of September 1840, and that the said Adam J. Surface & Sarah his wife from the time of their said marriage till March 1864 continued to live & cohabit together as man and wife, and reared a large family of children, that he is personally and well acquainted with the said Sarah Surface wife of said Adam J. Surface, and she is now alive no divorce having been granted to the parties or either of them,

That he has been shown the record of the county Court of Kenton County Kentucky, and said records

shows that on the 19th day of March 1864 a license was issued by the Judge of said Court for the solemnization of a marriage between the said Adam J. Surface and Elizabeth Snyder, and affiant has also been shown said license, from which it appears that the marriage was duly solemnized, by legal authority, between said Adam J. Surface & Elizabeth Snyder, and return thereof made and filed, affiant further says that the said Adam J. Surface so married in said county of Kenton Kentucky, is the identical Adam J. Surface whose lawful wife ^was then and^ is now residing in Preble County Ohio, and [...] and further saith not,
