Beriah Magoffin Governor of Ky
Your Petitioners Green M Witten & John B Harris would respectfully represent that they became the securities of one Richard Allen for his appearance as a witness in the case of the Commonwealth vs one Geo W Mayo on a charge of Tipling in the Floyd circuit court at its [...] Term 18[...] they state that sd Allen for whoom they were surity was in court on the day that the cause was set for trial and on each and every day for several days until the cause was continued and then sd witness left & some time during the Same term the Commonwealths atto had his witnesses called to have them recognised and Sd Allen was not presant and the recognizence of the witness & your petitioners as his Surity was ordered to be forfeited and a summons was ordered in the Same — They state sd Witness has been for two years or near that in the state of MO in Cass County, and unless your Excellency remits the Same they will have the $100 & costs to pay They say they have been trying in Good faith for near two years
to procure his attendance and have had Sd cause continued from time to time for that purpose — but cannot,, they say they would not ask a remission of Sd forfeited recognizance if Sd witness had not been in Court at the term at which he was bound as a witness & in each day for the Same but they do believe under these circumstances that they are by law released wherfore they pray thyour Excellency to remit Sd recognizance and as in duty will every pray &c
