To His Excellency Beriah Magoffin Governor of the Commonwealth of Kentucky —
Your petitioner Henry Eastman would most respectfully state that ^he^ rented a spacious building in Louisville known as the "Mozart Hall" for the purpose of giving a number and variety of Concerts — To make his business more profitable: He determined to set apart a certain Room in said Hall as a BeerSaloon — He deposited his money in the City Treasury, the full amount required by the License Inspector, to wit, One Hundred & Fifty dollars for licenses — He commenced selling as is customary with all Retailers of Liquors as soon as he deposited his money and filed his petition with the Clerk of the General Council — Thisisthe universalpractice. The City Council However refused to grant a License in such close proximity with a Concert Hall — Your Petitioner was then indicted & fined in the City Court of Louisville the sum of sixty dollars as for a Tippling House — This Indictment was found while his money was in the Treasury. There is no merits in the case; and altho the letter of the law was against him, the merits are on his side — He thinks this a decided case for the exercise of the Executive prerogative — He acted
in good faith with the Ciy and ceased to sell the moment the Council refused to give him license — He confesses that he was surprised by this action of the Council; but when said action was taken he bowed in submission — He protests against the equity of being fined — He prays that this fine may be remitted He suggests that the costs will be enough to remind him in future of the uncertanty of ^city^ councils —
