To his Excelancy Gov — Roberson
Sir your Petitioners will beg leave to state that at the presant term of the Livingston Circuit Court on the [...] day of said term A Elmore was tried on an indictment for keeping a tipling house in the town of Smithland & was fined 20 dollars for retailing of Liquor under said indictment the facts in the Case are about these that during the time that the U, S, Army was Stationed here in a large force the Military Authority by order had all of the Coffee houses in Smithland closed up & the trustees for the said town granted no Coffee house license during the time that Military law was thus declared that the said Elmore being refused his License by the trustees of the town as above for the above reasons alone he went to the Commandant of the post & procured a permit from him to open his Coffee house on the condition that Elmore would not sell Liquor to the Soldiers which he complied with that as soon as the Civil law went into operation again Elmore got out License from the Trustees according to law & continued his Coffee house we believe that he did all of this in good faith & without an intention to violate any law wherefore we ask that his fine be remited & much oblige yours & c
