A. J Denham of Edmonson County — was fined for an Aledged Assalt & Battery — in June 1861 before T S Sanders a Justice of the Peace for said County Two Dollars. & cost and nine days Imprisonment, from this Judgment he prayed an appeal and Executed Bond before the Clerk of the Circuit Court. If process was — Issued the same was not returned the clerk and sherriff both resigning their offices we had neither clerk or sherriff — from Sept 1861. to March 1862. the office was left unprotected. and many papers lost.

Denham has paid the fine & cost and Asks to be relieved from the Imprisonment. as a capias has Issued against his body — which has not been Executed from the fact that he is a member of the 12th Ky Cavelry —

I heard the testimony upon the original trial and believe that had the case been tried upon the Appeal that he would have not only — not have been imprisoned by the verdict of the Jury but that he would have been released from the fine also.
