The Council met pursuant to adjournment.
W. B. Machen President in the chair
Mr Thompson from the committee on Military affairs reported a bill entitled "an act to authorize the Governor to call out volunteers" Which was read a first time —
Ordered That said bill be read a second time
On Motion the rules of the Council constitutional provisions and second and third readings were dispensed with.
The question was then upon the passage of the bill- and being put was decided in the affirmative —
And so the bill passed
Ordered That the title be as reported-
A message from the Governor by R. McKee Secretary of State:
Mr President: I am directed by the Governor to lay before this council a special Message, in writing Towit:
"Executive Office
Bowling Green Ky
W. B. Machen Esq.
President of the Council of the State of Kentucky- Sir
I have

just received a dispatch from Henry J Lyon saying that he cannot go to Richmond before the end of next week, and as the business upon which he was appointed a Commissioner requires immediate attention, and Mr Lyons has not yet taken the oath required, I consider the office vacant and nominate John D. Morris as our Commissioner.

Pro. Governor
On Motion the nomination of John D. Morris as Bank Commissioner instead of Henry J. Lyon was unanimously confirmed.
Mr Crockett moved the following resolution. Towit
Resolved By the Council of the Provisional Government of the State of Kentucky. That the President of this body be directed to inform H. Smith Esq or the person in charge of the Peoples Bank at this place, that this Government will take possession of the buildings of said Bank on monday next for the use of this Government.
Which was unanimously adopted.
Mr Crockett from thecommittee on the Judiciaryto who was recommitted the bill entitled "an act to amend the execution and distributiong laws of Kentucky" reported a bill with the same title as a substitute for the original bill and amendment
Which was read- and placed in the orders of the day.
And then the Council adjourned until Monday next at 10 O'Clock A. M.
