Your Petitioner Elizabeth Rush would respectfully represent to your Honor that She was fined at the present term of the Kenton Circuit Court the sum of fifty dollars for selling Spiritous Liquor to a minor.
The proof was, thatJohn Davis who testified to the same before the court, that he was sick and ^frequently^ Sent his son to your petitioner for a Bottle of Whisky; and that his son ^stated that he^ got the whiskey and paid petitioner for it, ^and paid her for one drink, 5 cts,^ and took it home to his father ^that is the pint, Bottle of Liquor^ they being neighbours and for this, and this only, your petitioner was fined as above stated. Petitioner states that She had no doubt of the son being at least 21 or more years old, but She says She would have sent it to his father in such a case in any Event as he is her good neighbour, and she knew he was sick at the time with disease and she put some Barks in it for him. She further states that she did not know she was Violating any law when she committed the offince, wherefore she prays your Honor to remit So much of said fine as you can Lawfully and your Petitioner will Ever pray &C

I was counsel for Mrs. Rush on the trial. The testimony was substantially as stated above. The son who got the whiskey was between 20 & 21 years old at the time of the transaction,

I have no knowledge of the facts in this case & was not present at the trial, but from the signatures of the Commonwealths Attorney & Mr Myers who represented the defence I doubt not the case has merit for Executive interposition & therefore concur in the request of the petition
