To His Excellency Thomas E. Bramlette Governor of Kentucky.

Your petitioners James Harris Robert F. Baird and Jonathan H. Price most respectfully state that at the January Term of Jefferson Circuit they were taken as Bail for one Andrew Braden, who was indicted for Larceny- The ^Bond^ was three Hundred Dollars- Said Braden was a youth, and a soldier in the U.S. Army 2nd Regiment Ohio Volunteers. The charge against him, Stealing a Pistol, from a fellow soldier. We refer to the statement of the Examining Justice appended hereto for the facts of the case. It will be perceived that Braden had never concealed the pistol; But had carried it openly for several days- The Justice out of abundant caution required him to appear and answer at the Circuit Court. Believing him to be perfectly innocent of crime, and thinking the country needed the services of as menany men as could be obtained, and sympathsising with his youth, your petitioners became his Bondsmen. We have not heard from young Braden since; but have reasons to believe that he went into his country's service again, and whether he is dead or alive they are unable to state. His Bond was forfeited and a judgement rendered against us and execution stayed that we might make our appeal to the justice and clemency of the Governor of the Commonwealth — < ☞ - — - >
Believing therefore that it is a case in which the Executive might most properly exercise his prerogative, we most respectfully ask that a RemissionofthisForfeiture be granted; and as is duty bound will ever pray &c —

I was one of the Examining Justices in this case but have not the testimony before me it having been lost in the Circuit Court But from what I now reccollect of the case I dont think there was much of it Bradeon was found with a pistol that another person said had been stolen. Braden had had it for several days but had made no concealment of it. We held him over thinking there was probable cause, he was a soldier, and I am told went back to his Reg where he is now if not dead I think under all the circumstances the bail should be remited, as the army got the benefit of it as it sent the soldier back to his post;
