To His Excellency Tho^s E Bramlette, Govenor of the Commonwealth of Ky,

Your Petitioner would respectfully complain and State to your Honor in this [case] -- that at the March Term 1861 of the Taylor Circuit Court one Tho^s Atkinson, was Indicted by the Grand Jury of Taylor County for petit larceny that a bench warrant issued against the s^d Tho^s Atkinson and that the s^d Atkinson was taken in charge by the Sheriff of said County-thereupon s^d Atkinson executed a bail bond in the Sum of two hundred Dollars. together with your complainer and one Cha^s Atkinson as Sureties on Said bail bond or recognizance -- your petitioner would State that the said Tho^s AtKinson joined the arny of the United States in the year 1861. and was not able as your petitioner is informed to obtain a furlough of absence to attend Court and surrender his body in discharged of s^d Recognizance-and that at the last March Term of s^d court the s^d bond was adjudged forfeited by said Court, and afterwards (to wit on the [ ] day of [ ]1863. Summons was issued by the clk of the Taylor Cir. Court against the sureties on said bond
of which your petitioner is one to Show cause if any, why judgment Should not be rendered on s^d forfeited bond, Your petitioner would respectfully State that that at the time he went on said Recognizance Judge Elias L. Barbee ^now^ Dec^d informed him that if said Tho^s Atkinson belonged to the army of the United States, that s^d bond would not be forfeited, provided said Sureties appeared in & indicated to the Court that they were willing to Stand on said Recognizance until the said Tho^s Atkinson was discharged from the Military Service-which your petitioner States he did- but as his co-surety Cha^sAtKinson was not present, the Comth's atty insisted that said bond Should be adjudged forfeited-which was done as before Stated-Now your petitioner States that he Showed these facts to his honor the said Court in answer to said Summons on said bond-but that they were adjudged insufficient as ~~they~~ your said petitioner had not taken the proper Steps as he is now informed to abtain the body of said Atkinson from the Co^l Commanding the Regt, to which the said Tho^s Atkinson was and
is now a member-he States that judgment was rendered on said bond for the said two hundred Dollars. & costs at the present Sept. Term of Said Court-

Your petitioner States that he is a poor man and has to work at hard labor in the Black Smiths Shop to obtain a Support for himself and family, of which he has Several members- The following Subscribers and your petitioner respectfully Submits the above facts to your Honor, and prays the Executive clemency in his behalf.
