To his Excellency Gov. Bramlette-

On the [ ] day of [ ] 186[ ] Graham Akin of Danville, a youth of about 14 years of age, very delicate & slender, was attending the school of a Mr Waterman in the city of Frankfort Ky —

Thomas Davenport, about the age of 17 or 18 years, Heavy & stout, was attending the same school —

Akin was swinging in the gymnasium when he was interrupted in his exercises by Davenport's standing in the way of the swing. Akin requested Davenport to move and not obstruct him- which Davenport refused to do; Akin continued his exercises and slightly brushed against Davenport, whereupon Davenport Choakedandotherwise maltreated Akin, who, suffering from the severity of Davenport's treatment, rushed into the house of Mr Waterman, sezed his gun and shot Davenport with smallshot —

Akin was indited by the "Grand Jury" of Franklin Co- at its June session in 1863 for "shooting, in sudden heat and passion, on Thomas Davenport, with intent to kill" Akin was held to bail in the sum of $600⁰⁰ to appear at the next October Term
of said court, to answer unto the Commonwealth of Ky as stated in the inditment.

He appeared ~~and~~ in open court on the 12th day of October 1863 and on the 21^st day of October 1863 was arraigned and plead "Guilty" to the indictment — The Jury accordingly returned a verdict of "Guilty" assessing his fine at fifty ($50) Dollars —

Deeming this to be a case in which your leniency would be well exercised, We therefore pray you to remit the fine —
