Your Petitioner Robert Shannon would represent that some time in March last he became Bail for his son John B. Shannon in the Fleming Circuit Court in the sum of $500. for the appearance of his son at the Sept. Term following to answer to an Indictment pending against his son for horse stealing- He states that his son did not appear at the September Term as required and his Recognizance was Forfeited- The circumstances of the alledged crime of his son are these- In 1862 his son, then Residing in the South East part of of Nicholas County, was a member of the home Guards & when the Rebels came into the County ^in the fall of 1862^ unexpected to him he left home in a hurry on foot, when twelve miles from home in Fleming County he took a horse belonging to Henry Johnson and rode it and was afterwards arrested for stealing the horse The horse was found with him and restored to its owner & his son Indicted as above stated. Since which his son has removed to Illinois where he now resides- He says his son is poor almost without means & Your Peittioner is also poor and to pay the liability on his forfeited Recognizance will oppress & distress him- He says his son was in danger and it was necessary for him to leave home as he did The taking of the horse tho. not justified at all ~~were~~ ^was^ under the circumstances above stated. and in view of these & his own Condition
he is induced to ask the Clemincy of your Honor. Your Petitioner knew he was not able to stand the Bail if it was forfeited, but he could not refuse his sons request

He therefore prays you will remit the forfeited Bond & will ever pray &^c.
