Your petitioner John M^cKinny would state to your excellency that at the Nov term 1863 of the Estill circuit court he was indicted for selling whiskey or spirits to soldiers ^& fined $60^ the facts are these he the said M^cKinny was acting as sutler of the 47^th Kentucky regiment & by the direction of the Physician of the regiment he procurred spirits to sell & by directions of said Physician he did sell to various such soldiers spirits & did also sell to various soldiers a drink at the request & orders of the said physicians & officers that said M^cKinny is a good & well disposed citizen & a loyal man & believes that his fine ought to be remitted this 6^— Nov 1863

Gov. Bramlette I understand that the Deft McKinney sold whiskey under the direction of Dr. Daniel believing that he had a right to do so — I believe it true and hope you will remit the fine McKinney is a good man and will not be guilty of a similar violation of Law.

There was a good deal of Sickness in the Camp, I told some of the sick soldiers they might make use of some spirits

I think it that the verdict against M^cKiney & Williams is unauthorized either by Civil or Military law they being Recognized by us as the sutlers of our Regt being ^elected as^ such by a unamims vote of the Regt

I waited on the sick at Camp Wilson over two months there were many cases of Measels and in quite a number I of cases I recommended spirits and so informed M^ckinny and willams
