To the Excelence of the Govoner of the Commonwealth of Kentucky your petitioner wold Respectible Represent to your Excelence that at the [ ] term of the Whitley Circuit Court the grand jury of Whitley County Returned an inditment a gainst your petitioner for caring concealed deadley weapons and at the august term of Said Court 1863 they had a trial in the absense of your petitioner and Rendered a Judgement against him for fifty dollars fine your petitioner states that he attend the term when Court shold have ben held on the two [...] days and they was no Court in sesian and baleaving they wold be no court he went hom ~~and~~ beleaving they wold be no Court and to his suprise the Judge come and opened court and they triede the aforesaid cause in the absense of your [...] and Rendered the Judgement as before stated your [...] states that if he had of been present in court and trial he wold have been able to of proved that he had Reasonable Grounds to beleave that his peasan was in danger of violence your petitioner states that he is a pore man and if he has said judgement to pay it will do great in Justice to his famley Wheare for he as your Excelence to interpose and to Remite the fine and for all proper Releaf

The excuse given in the petition is not a good one for not making defense and in ordinary times would not justify Remission but in a time of Civil war when every loyal man ought to be armed for defense; I think none should be fined for being armed. I therefore remit the fine except costs & fees Nov 24" 1863
