To His Excelency

Whereas a Judgement was rendered against Thomas P Boggess in favor of the The Commonwealth of Kentucky ^at Novr Term 1863^ The facts are about these at the Novr term 18621 Boggess was recognized as a witness for the Defindants on an indictment ~~[...]~~against J W & M L Simpson charged with aiding in the escape of a prisoner from Jail Boggess was at no time ever recognized on behalf of the Commonwealth at the May Term 1863 the action of the Commow^lth vs Simpson was continued and on the recognizanc of Boggess was forfeited on motion of the Attorney for the Commonwealth at the time Boggess was in the hands of the Military authorities under arrest- So soon as the sumons on the forfeited recognizance ~~issued on~~ was served Boggess spoke to one of the counsel for Deft Simpson to know why the forfeiture was taken when the counsel replied that it must be through mistake and he would have the matter corrected- upon these facts Boggess did not attend for the purpose of
of making defense and Judgement entered -- After this a motion for new trial or to set aside the Judgment was made but overuled -- We therefor request your excelency to remit said Judgement-

The facts in the foregoing petiton. I can say are ^true^ of my own person Knowledge, So for as they refer to Matters of record, but what he was advised by one of the counsel for the Deft I can only Speak from the affidavits filed for ~~[...]~~new trial- from those facts I think his cause meritorious and Calls for Executive clemency
