The Plantiff States that the defendant Samuel Brown on or ~~before~~ about the Sixth day of August 1859 was arrested & brought for trial before N Howard Police Judge of the Town of South Carrolton in Muhlenberg County for the tral of an accusation against him charging him with Shooting Abraham Attic with intent to Kill him which is [monparticularly] shown by a bench warant herefiled as a part of this petition marked (A) and the action or trial being posponed from the 6^th day of August 1859. to the 8^th day of August 1859. the defendant executed & entered into a Bail Bond or recognisance before the said Judge undertaking that the Said Brown among othor things would make his appearance before the said Police Judge on the Said 8^th day of August 1859 to Answer Said Charge & not thereto depart without the leave of the Said Judge and if the Said Brown failed to comply with the requirements of Said — that the Said defendant would pay the plaintiff the Sum of Two Hundred dollars which more particularly is shown by refferance to Said Bail Bond here filed as a part of this petition Marked (B) The Plaintiff further States that the defendant Brown did not make his appearance before the Said Judge on the 8^th day of August 1859 as required by the Said recognizance but forfeited the

Same (having been released from the custody upon the execution thereof) The Plantiff further Says that in Addition to the forfeiture of the said Bond by the Said defendant the Same by written endorsement on Said Bond on the 8^th day of August 1859 declared the Same forfeited wortheless the defendants hath hither to wholy failed & refused to pay the Said Plantiff the Said Sum of Two Hundred dollars or any part thereof Although requested so. to. do, The Plantiff also Charges that the defendant Brown about the time & Shortly before the time for his appearance under Said recognizance on the 8^th day of August 1859 preparatory to a forfeiture deposited the amount of Said bond with the deft Reno & left the State wherefore the Plff prays Judgment against the defendants for the sum of $200. and for other proper releif

This day came the plff as well as the deft Jn^o E Reno by his Atty and On his motion leave was given him to withdraw his answer And thereupon Said Reno in Open Court Confessed Judgement in the Sum of Two Hundred Dollars It is therefore adjudged by the Court that the plaintiff recover of the defendant Jn^o E Reno the Sum of Two Hundred dollars with interest from this day & the Cost of this action
