At the March term of the Ballard Circuit Court, Francis Garner, was fined $83. and two weeks imprisonment for a Breach of the Peace and I am requested to represent to the Executive the reasons which appear to exist for the exercise ^of the^ perrogative of Mercy. I have but little knowledge of Mr Garner previous Character, or the causes of Justification or [palation] in his case. From my observation since his conviction, and from what I have been able to learn in regard to him he has generally been quiet and orderly,. and I do not by any means consider him as a dangerous character. He is a young man and had ~~since~~ before his conviction, entered into Marriage, and hence increased his responsibility as a member of society. My Judgement from a carful survey of all the facts in his case, is that the fine will fully satisfy the Commonwealth for the Offence committed, and that the imprisonment ought to be remitted. I think also that if the executive should not think it proper to interfere with the Judgement, by remitting a
a portion of the fine, that a respite for 12 months would be an act of mercy properly bestowed
