I Edw. W. Hawkings state that on the [ ] day of [ ] while I was Mayor of the City of New Port held an examining Court as Mayor for the trial of Kennedy and Patrick White on the charge of rape committed (as alleged) upon on Elizabeth Franklin

At that trial before me Elizabeth Franklin the prosecution stated under oath that Kennedy had two connection with her, the second time within two of three minutes ^(~~or within an exceedingly short time~~)^ of the first connection, but that White had no connection with her at that time -- She was very positive in these statements & the atto. for the Defendants made before me points as to the improbability of the Defts having two such connection as alleged by the prosection --

Jonathan Horsefall says he is jailer of the city of New Port, and heard the Trial before Mayor Hawkins as an examining court for the trial of Kennedy & White -- his recollection of the testimony of Elizabeth Franklin corresponds fully with that of Mayor Hawkins as above set forth -- Elizabeth Franklin had a child previous to this prosecution & has been confined in my jail on the charge of theft & is of bad general charatcer

W H Bennett states that he was City Marshal at the time of the prosecutions referred to in the above statments was present at the trial & the statements of W^m. Hawkins & Horsfall and true.
