To his Excellency the Govnor of the Commonwealth of Kentucky.

Your Petitioner Richard Lucas states that at the Sept term 1863 he was indicted for keeping a tipling house for three months and for Permiting or Suffering gaiming in his house and was tried under said indictments at the March term 1864 ^of the Shelby Circuit Court^ he was tried and fined in Each case in the sum of $200 —, or $400 — in boath cases. that all the gaming permited or proveed to have been in his house was a game for a treat & that he did Sell whisky but he obtained a licencs from the government of the United States So to do and that he was informened and So believed that was all was by the laws in Such cases Required. your Petitioner further states that he is now and has been confined to his bed with what the Doctors pronounce consumption for the last 8 or 10 months and never Expects to be able to pay Said Judgment or any part thereof but dose not wish to depart this life with Said fines hanging over him and that he is a poor man and has a Small family and dose not wish them annoyed with Said fines. Wherefore he prays that your Excellency will interpose the Executive clemency
and Remit Said fines and for all other proper relief.

personally appeared Richard Bryant and made the following statement that the statements in the foregoing Petition in regard to Lucas health are true and that of his obtaining government licens and he further States that the two witnesses J. B. F. Stagers & D Porter that fixed a three months [Selling] on Said Lucas bought the whisky from me when Lucas was sick and had ordered me not to Sell to any one under any circumstanc that I was aucoping the house as tickett agent and no others

I have known Mr. Lucas since August last. He has been all the while in quite feeble condition & in fact confined to his room almost all the while ^during^ the last four months with diseased lungs. He is & has
been wholy unfit for any business & in my opinion will not be again, as I look upon his recovery as very doubtful,
