James Keeth Defendant

This affidavit James Keeth states that sometimee in the year 1861 he had ~~and~~ whiskey to sell and that while selling the familey of R C Tredaway came to to him and represented that they wanted whiskey on account of sickness in the familey The affiant states he Informed them that he could not sell whisky in So Small Quantities but after insisting this affiant let them have whiskey in smaller Quantities that was authorized by ^Law^ he states he thought it no offense as it was in case of sickness

he states that aftewards he was Indicted for the offence in the Clay Circuit Court he states knowing the facts he confessed to have been guilty whereupon the Court past Judgement aginst this affiant at the ^Novr Term 1863^ for Twenty dollars, he states that these are the facts in Substance of the case he states he is a very poor man and getting old and his children have all left him he states he is scursley able to provide for himself & wife and to Enforce the Collection of the Judgment would prove a great Embarrassment H he states he regret in having violated the Law of his state askes Your Excellency for the remittance of the fine and will violate the Laws no more

Dear Sir on the other page of this petition you will find the affidavit setting forth the case of the Commonwealth against James Keeth a citizen of Clay County Ky which I think fully Embraces the facts in the case I am well acquainted with the Defendant James Keeth know him to be a poor Labouring and honest upright citizen and no wise desireing to violate the Law if he knew it such being the case I think it would be a deed of Charity worth Exercising your perogative

he is an illitterate man of noble intentions and Earnestly hope you will remit the fine and relieve the old man from further annoyance
