The affiant Wood states that at the March Term of the Madison Circuit Court for 1862. The Grand Jury for said County found a true bill against him for Keeping a Tippling House

That said case was postponed from time to time till the March Term of said Court 1864 at which court a Judgment was rendered against him by default for $60 & costs

He states that the reason he was not in attendance at the court aforesaid he was confined to his bed by sickness and that he was wholly unable to attend. He says he is not guilty as charged in the indictment and that upon a trial the Commonwealth would have utterly failed to make out a case against him

He states that he did not violate the law and that it is hard he should be fined on account of his physical disability to appear and make his just defense

In addition to this affidavit he will obtain the statements of his attending physician and his neighbors for the truth of the above statements

He states that he is in bad health and that he is a very poor man with three motherless children to
maintain
