The parties appeared by their attorneys and the defendant moved the Court to continue this prosecution and said motion being fully heard and understood is by the Court overruled and thereupon came a Jury to wit W B Kendall, L M Lee J M Moore James Black P R Vaughan John S Berry J Q A Davis James C Burgess P M Vaughan J W Nichols Robert Johnson & Henry Tarpley who being elected tried and sworn well and truly to try the issue joined and having fully heared the evidence and arguments of counsel returned into open Court the following verdict (viz) We of the Jury find said Clark guilty as charged in the within indictment and by reason thereof assess his fine to the Commonwealth at the sum of One hundred & six dollars May 15th 1860.

It is therefore adjudged by the Court that the said defendant make his fine to the Commonwealth by the payment of one hundred & six dollars and that he pay the costs of this prosecution and may be taken &C.
