Commonwealth agst William Whalen and Lewis Keinor, Stealing iron and iron springs and iron axels from Christian Quinot.

Christian Quinot, Lives on Main Street near Webster street. I am a Blacksmith about six weeks ago, there was stolen from my shop two steel springs for wagons & several pieces of broken springs, three iron axel trees and some old iron all of the value of about $50, it was stolen in the night time. I subsequently found all of the springs. one axel tree and some pieces of old iron that had been stolen from me, at the Rolling Mill in this city. I had given notice as soon as I discovered my loss at the Rolling Mill and when they purchased the articles word was sent to me and I went down and knew the articles and picked them out.

John Quill Lives on Green st between Brook and Floyd, works at the Rolling Mill, about the 10^th of February last accused Whalen brought to the Rolling Mill some broken springs and two springs not broken some iron axels and some old iron, the --
articles were offered for sale and -- weighed and thrown aside, a ticket of the weight was given him and he was directed to present that to M^r Coleman one of the proprietors and get his money --, saw Whalen at the mill afterwards, dont know whether he got the money or not, some days after Quinot came to the mill and picked out the articles brought there by Whalen and claimed it as his,

Dennis Shay, Works at the Rolling Mill Lives on Market street near Hancock, I weighed the iron brought to the Mill by Whalen and gave him a ticket, Quinot subsequently came to the Mill picked out the iron claimed by him and got it,

J. M. Coleman, Lives on 3^d street between Walnut and chesnut, accused Whalen came to me and presented a ticket for iron and asked for payment, The ticket had been given to accused Whalen by the name of Robert Burns, I had previously received notice from Quinot of his loss and told and told him that fact and that he Must bring Quinot and if he did not claim the iron then would be pay him, he went away, the same day accused --
Keinor came to me and presented the ticket and asked for the money, I asked him where the Young man was who had presented the ticket in the morning and he said he was his partner and he came to get the money and I then told him that Quinot had given notice of the loss of such articles and that he must go and bring him before would pay the ticket and he went away and returned I think the next morning and said he had seen Quinot and that Quinot said it was not his iron. I told him I would not pay the ticket until he brought Quinot to me in person and he then left. Keinor told me that his partner Whalen had bought the iron in the country beyond Beargrass, -- we -- have before this brought scrap iron from Whalen -- Whalen also told me he had bought the iron in the country,

W^m Hipnell myself and Garratty arrested accused on Requisition of the Governor in Nashville Tennessee, previous to that had attempted to arrest them, saw them together on two occasions and they escaped from as both times by running -- once when they were coming
on a wagon meeting us they jumped off and ran through the creek.

Thos Garratty same as Hipnell.

Whalen held in $400, to ans Felony

Kenior held in $300, to ans Misdemr,
