Dear sir

Your Petitioners members of the bar and Jurors of the County at the Present term of the circuit court in this co Would respectfully represent that at this term of the court one Calvin F. Dyer was tried in an indictment for receiving stolen horses and was upon sd trial convicted and sentenced to the Penitentiary for one year they state that they do not beleive the evidence proved him guilty; and since his conviction evidence has been discovered that were clearly establishes the fact of his innocence, and a new trial being refused him, we feel in Justice to the prisener to ask your Excellency to Pardn said Dyer as we verrily believe he is inocent, the Jury themselves who found a verdict of Guilty unites in this Petition for the Pardon of the Prisener the Commonwealth on the trial did not prove the property stolen, did not prove that the deft knew it was stolen nor did she prove who was the owner of the Preperty; The Evidence established the

fact that the horses was put in the defts field in the night by some unknown person, and that Deft knew nothing of it until next day and then sent word by verrious persons out into the country that such property was on his premises this was proved by 4 witnesses on the trial

The deft is poor has a large family of children whoes mother is dead and who has no step mother with whoom to live in the absence of their Father the convict

We do hope Govenor you will Pardon him and send him home to his children, hoping you will find it consistent with your feelings and the public interest so to do we subscribe our selves very respectfully your Petitioners
