We the undersigne,,. Witnesses set down at the foot of the several Indictments.. against E,, N,, Daniel.. & Brother,, For keeping a Gaming House,, Setting up a Gaming Table,, and two Indictments' 'for permitting minors to play upon said Table" respectfully State to your-Excellency,, That we are satisfied from the facts within our knowledge of the setting up of said Daniel & Brother,, that it was not the purpose of intention of said parties to induce Gaming or to keep a Gaming House,, for we know that all gaming was not only forbidden by the Messrs Daniel by posted rules,, but we have heard them forbid and prevent parties playing time and again for liquors,, and cigars,, not one of us ever saw or heard of money being bet upon any game upon said Table and while some of will swear that liquor,, and cigars was some times paid for by the parties playing yet we cannot say that either of the Daniels, knew it, but have no hesitation in saying that we do not believe they did know it,, We the Minors charged with playing upon said Table,, State that the moment the Messrs Daniels was informed of the law. we were never permitted to= play upon said Table,, That all the parties who have been tried at this term of the Court have been acquitted,,
