To hHis Excellency the Governor of Kentucky

Thomas Smith, your petitioner states that he became surety for James Gartlin's appearance in the Fayette Circuit Court at its February term for the present year, that said Gartlin failed to appear at said Court, the bond for his appearance being forfeited, that said Gartlin has escaped from the state of Kentucky and is now in the State of Ohio ^afugitivefromjustice^, that there is an indictment against said Gartlin wherein he is charged with receiving stolen property knowing it to be stolen, that said indictment was found by a regularly constituted Grand Jury of the County of Fayette, in the Fayette Circuit Court and is the same indictment, upon which a bench warrant was issued whereon he was arrested when the above mentioned bond was executed. Your petitioner respectfully prays that Your excellency will take such steps as are necessary to secure the presence of said James Gartlin in the Fayette Circuit Court which is to convene on the 12^th inst, Your petitioner went on said Gartlin's bond believing that he would make his appearance and he, having failed to comply with his bond by appearing in Court your petitioner thinks it his duty to do all in his power to have the delinquient brought to jus-
tice that he may be punished if guilty and that the Court may, if he thinks proper, havetherighttoremit the amount of the bail bond which the Court can only do by a surrender of the accused. All which is respectfully submitted.
