This evening I shall enter the service of the U.S. — Up to this date I have had a number of Kentuckians under my Command who volunteered to take service under the Govt of the U.S. in the unnatural war made upon the Govt by Southern Disunionists. I this evening shall accept the Commission tendered me as Co^l1st Regt Ky Volunteers & tomorrow shall have my Reg^t mustered into the service. — I therefore notify you that from this date the office of Judge of the 6th Judcl District will
not be exercised by me. And to save all questions of Constitutional difficulty as to fixing the vacancy I herewith tender you my resignation as Judge of the 6^th Judicial district of the Commonwealth of Kentucky, to date from this date.
