Respected Sir-

I rec^d a Communication last evening from Gen^l Buckner informing me that your Excellency has refused to accept a resignation tendered by me — Since having done so I have had occasion and time to examine the Law and find that my act in so tendering a resignation was unnecessary — In proof thereof I refer your Excellency to §24, art 6^th of the Militia Law which refers to Section 1^st Art 7^th of the Constitution of this State — Although having rec^d a Commission I have never complied with either, by taking the oaths prescribed, and neverwill, consequently never having accepted by complying therewith I have never qualified as an officer of the Ky state Guard, and with past experience shall never consent to be a member thereof — Is not my position correct? —
