Bowling Green Ky Aug 22^nd 1860
To his Excellency Beriah Magoffin,
Gov, of the State of Kentucky

Whereas of one James Whitlow, was tried on an indictment at the August Term ^1860^ of the Warren Equity & Criminal Court, charged with "carrying concealed deadly weapons," and fined fifty Dollars. Under the following circumstances, and proof. M^r Whitlow is an exceedingly poor man, with a family depending on his daily labor for a support, and the proof being that he carried a pistol, which was not "deadly', but on the contrary that it was entirely harm less, being so deficient in some of its parts, that it could not be shot, and further the proof as to the carrying the weapon was only made by our witness, whose character could have been successfully impeached had not motives of delicacy prevented this petitioner from attempting it, the witness being a female. Now in consideration of the premises and the fact that the coercion of said fine, would operate opressively, especially these "hard times," We the undersigned commend M^r Whitlow to your Executive Clemency as an object worthy of your pardoning power and respectively pray that said fine be remitted --
