To his Excellency the Governor of Kentucky

Your petitioner W^m B. Robinson respectfully states that at the Nov Term 1860 of the Scott Circuit Court on an indictment for assault & battery, a verdict was rendered against him for $50 & 15 days imprisonment. He states that at the time of said trial he & his attorney were both absent and no one was present to attend for him. Relying upon the presence of an attorney who is a regular practitioner of said court to whom he has spoken when the indictment was returned, he did not deem it necessary that he should be at court, as he was detained at home on urgent business — His attorney did not as he is informed, reach the court on time for the trial — The indictment was returned in Nov 1857 and has been continued from term to term by the Commonwealth, for failure of witnesses to attend and for their conduct & statements he had every reason to believe that they had determined not to prosecute. He is satisfied that had he or his attorney been present at the trial, he would have been acquitted — He respectfully petitions your Excellency to remit said fines & imprisonment
