To his Excellency Beriah Magoffin Govener of Kentucky —

Your petitioner would state that at the July Term 1859 of the Mercer Circuit Court he was fined the sum of sixty dollars for selling ardent spirits as a Tavern Keeper, he states that he applied to and obtained from the Mercer County Court a License to keep tavern in the Town of Harrodsburg and under this license he admits he did sell ardent spirits — He says that when trial of the case on he was necessarily absent from the Mercer Courts and the case tried in his absence & having no one to represent the facts, he was found guilty, that he did not know of the finding untill it was too late to get a new trial or make any move in the matter — He says he had regular town house, paid the tax & done every thing required by Law and sold no ardent spirits untill after he obtained License to keep Tavern & not selling before his License appeared — He asks your Excelency to remit the fine
