against } Upon an Indictment
Simon Engleman Defendant

This day came the attorney for the commonwealth and the defendant pled not guilty and thereupon came the following jurors towit Craig Lynn, Ja^s M. Bruce, John M. Bruce,
W^m Young, W^m C. Hackley, W^m T. Green, Joseph Robinson, W^m H. Hacker, A. M. Feland, Logan Lynn, and James Paxton by consent the foregoing 11 Jurors were sworn to try the issue, after hearing the proof rendered the following verdict towit, we of the jury find the defendant guilty and assess his fine at $50. J. S. Bruce foreman. wherefore it is adjudged by the court that the defendant make good his fine with the commonwealth by the payment of $50: also the her costs expended incident to the rendition of this verdict.

To his Excellency Beriah Magoffin Governor of Kentucky

Your Petitioner Simon Engleman respectfully represents unto your Excellency that
at the September term 1860 of the Lincoln circuit court he was by the judgment of said court found guilty of the offense of having carried a concealed deadly weapon and fined $50 for said offense.

He states that he was not present at the trial, which occurred before he had reached town. The witness stated that ~~upon~~ the occasion when he was seen with the weapon (a pistol) was during a difficulty which occurred in Stanford between James D. King and Andy Kennedy persons to neither of whom your Petitioner was related, nor was he in any wise concerned in the difficulty: that he never had a difficulty with any body in his life. that he is not in the habit of carrying concealed weapons and had none on the occasion referred to.

The witness for the Commonwealth was a boy some 13 or 14 years old, that he has no doubt whatever of the witnesses honesty but supposes that he was mistaken in regard to the person

Petitioner as before stated, never in his life having had a difficulty with any one and the witness evidently being mistaken in regard to the identity of the person your Petitioner respectfully requests that your Excellency remit the fine against him

My Dear sir my son Simon Encloses to you the within petition I have no doubt of the truth of his statements he never had a dificulty in his Life with any human being is the most peaceble boy I Ever Knew -- and on the day when he is said to have had the dificutly I know he would have had no cause to show a weapon as neither of the parties were anything to him -- both strangers and I Learn from persons who heard the testimony that the boy swore that he only saw the handle of the pistol in his pocket I further know that my son is not in the habit of carying weapons and feel confident that there must be a mistake about his having one on the occasion refered to in the testimony of Witness I therefore Respectfully ask of your honor a remission of the fine and am certain if you knew my sons habits you would certainly remit the Same
