To His Excellency Beirah Magoffin
Governor of Kentucky.

Your Petitioner Jacob Elderkin, states that at the June term (1860) of the City Court of Louisville, he was fined five hundred dollars for an alleged assault & battery on [ ] and one hundred dollars for an alleged assault and battery on [ ] He states, that he was not present at the trial of Either of these cases — and was not represented by an attorny; but was Engaged on a boat Going from Louisville to New Orleans at the time of trial. The costs in both cases ^including atto^s 30% of fines — ^ amount to two hundred & forty six dollars & ten cents. He has replevied the sd fines including costs which amount in all to ~~eight~~ six hundred and ~~forty six~~ Fifty three dollars & ~~ten~~ 80 cents. He states that he has been Engaged for the Ensuing pork season at the House of Hamilton & Company. and that the wages which will accrue to him for his winter work will Just about pay the costs, but will not be sufficient to pay the same, and board and clothe him for the winter The fines assessed against him are certainly Enormous. He is a poor. young man, and wholly unable to pay said fine, He relies upon his daily labor for a support He has no property of any kind He promises, if your Excellency will remit these fines, that his name, shall never appear on the records of said Court again, unless in case of absolute necessity, Wherefore he most respectfully prays that said fines be remitted.
