Pascal Warren a citizen of Green County, states that he was a witness on th trial of James Jones in the Taylor Circuit Court on a charge of permiting gaming in his house — and this affiant states, that the house in which it was alledged that James Jones permited gaming belonged to to W^m Jones the father of James, and although not immediately attached to the house of said W^m Jones, yet it was used by him as his grocery and bar room — for all which the said W^m Jones held a Licence from the county court to keep tavern — this affiant further states, that he was frequently called upon, especially at busy times to assist in the bar room to deal out liquor to customers and on the occasion, when James Jones was charged with permiting gaming in said grocery or bar room, this affiant was officiating as bar keeper — at the request of the said W^m Jones — On that occasion there were several persons came into the grocery, and got to playing cards, for amusement, as they said, in reply to me when I told them gambling would not be allowed in the house — whilst thus engaged, James Jones came to the grocery, and said to the boys, that if they were gambling, it would not be allowed, and continued he, the old man (meaning W^m Jones) is coming, he will stop your card playing — the old man came in while they were playing, he ordered them to quit playing, and they all immediately quit the game they were playing The said James Jones did not engage in the play, nor did he at any time, so far as I know claim to own or control the house — Given under my hand Decr. 28^th 1860 —

The affidavit of Ottowa B. Skaggs, who states, that he came to the grocery on the day alluded to by P. Warren in his affidavit — while there several persons came in, and several of them got up a game of cards, but there was no betting as far as I saw, at any rate no money was staked and they said they were playing for amusement — James Jones who was said to be sick at the house, came to the grocery, and seeing the card playing, said to the boys they must quit gambling, that it would not be permited, they replied they were not gambling, he told them they must quit any how= said the old man was coming and that he would make them quit — the old man (W^m Jones) came in about that time, and they immediatley quit and left the house — Given under my hand this 28^th of Decr. 1860 —
