To His Excellency Beriah Magoffin Gov of Kentucky

The undersigned Your Petitioner Would respectfully represent that a fine of Fifty Dollars was imposed upon Your petitioner under the following circumstances (Viz) On or about the 1^st of November 1859 Your Petitioner obtained from the Boyle County ^Court^ a license to Keep a Hotel in the Town of Perryville, also to retail Spirits, and on or aboout the 1^st of September last, my Son without my Knowledge, Sold a Young Man who is Said to be under the age of Twenty one Years one drink of Whiskey, and on the 5^th day of the present month, a warrant was issued against Me by a Justice of the Peace, and I was forced into trial forthwith and a Judgment rendered against Me for Fifty dollars, for said Offence. When it is Known to most of the citizens of Perryville and vicinity that I have upon divers occasions refused to Sell to Minors. It is also Known by all persons here, that I am an orderly and law abiding Citizen in every respect. Your Petitioner therefore respectfully asks your Excellency to interpose and remit Said fine, and in duty bound Will ever pray

Dear Beriah

The foregoing Petition was drawn up by us and Will State that We Know the facts as Stated in the Petition are true, and have no hesitency in Stating that the names of two thirds of the Citizens Could be obtained to have the fine remitted, but thought it hardly necessary to do further than to State the facts with one Signature giving it as our Candid opinion
that the fine Should be remitted, and advised M^r Tucker not to take the usual Course in obtaining a list of Names, that we believed you would have Sufficient confidence in our Statements to remit the fine. We took great pleasure in reading your letter to the Commissioners from Al^a and fully concur with your Sentiments express^d... Our regards to your family
