Your Petitioner John Sizemore would respectfully represent that at the spring term 1860 of the Floyd circuit court he was find $30 — for a breach of the peace on an indictment — He further says he was not Guilty of any offense whatever but was by accident in company with some man who was drinking and that they became noisey and to some extent bosterous and he being duly sober tried to Quiet those who were drinking all this occured near the house of one Mr Click who made the indictment and who was so distant he could not designate with certanty the persons really making the noise he says he was therefore fined by the Jury the sum afforesaid he says he was sober and did all he could to prevent noise & confusion and he thinks it hard he should have $30 — and cost to pay for trying to pressure order he therefore prays your Excellency to remit sd fine
