J. P. Rosco and R B Ratliff State on Oath that they were two of the grand Jury that found the Indictment for murder against James Williams, that whilst they were empanneled as said grand Jury the attorney for the Commonwealth drew up an Indictment for murder a against James Williams for Killing D. B. Calvert. That said Grand Jury refused to find a Bill or indictment for murder against said Williams under the state of facts as detailed before the Jury by the witnesses_ and the Commonwealth attorney, ~~due~~ informed the Grand Jury, that if they would bring in a Bill for murder and the court refused to grant said Williams Bail upon said indictment that he would enter a dismisssel to the indictment for murder, and send the grand Jury back to their room to find such an indictment against said Williams as they thought fit, and upon this assurance upon the part of the attorney for the Commonweath that they bought into court an indictment for Murder against said Williams, affiants for the state that
the grand jury was fully satisfied from the evidence adduced before them that James Williams was ~~only~~ guilty of manslaughter ~~to make the worst of the matter~~ as it appeared before us in evidence and the affiant J P Roscoe States that he was the foreman of the grand Jury that found said Bill of indictment above refered to against said James Williams for Murder a foresaid
