At the request of the friends of the petitioner W^m. Frooks & the Keeper of the workhouse M^r Horner — I am induced to make the following statement of facts, for Executive consideration — In April 1860 — an Indictment was returned to the city court in the name of the Com^th of Kentucky vs W^m. Frooks for an assault & Battery made returnable to the first Monday in May 1860 — the Deft was recog
=nized in the sum of $100 — with one security to appear and answer s^d. charge the Deft & his Bail appeared in court on the day of the trial & Deft was tried & fined $5=00, his Bail says by some mistake or gross wrong — the Recognizance was forfeited vs Deft & Bail — Deft was at the time employed as a hand on a coal boat destined for the South & left the day of the trial but returned several times between the trial day & the time of his arrest which was on the 28^th Jan^y 1861 — he had landed late the night
before and at breakfast time next morning was taken into custody — at the instance of his Bail, (Conally) to whom he p^d. $40 — which was all the money he had & that was p^d over to the officers for fees — the remainder was remitted by y^r Excellency — this man has been in the workhouse about One month his friends would pay the costs if y^r Excellency will remit his fine — this seems the effect of ignorance on his part or mistake on the part of others which may well claim Executive clemency with great respect y^r obt serv^t
