Against } Indict
Llewellyn Gillispie Defendt.

The Grand Jury of Bracken County in the name and by the Authority of the Commonwealth of Kentucky, accuse Llewellyn Gillispie of the offence of unlawfully erecting a fence in and across a certain public Road; Committed as follows towit.

The said Llewellyn Gillispie, on the 29^th day of August in the year of our Lord one thousand eight hundred and fifty nine in the County aforesaid, then and there being the owner and tenant of a certain tract of land, situate & being in a certain public Road, then & there being unlawfully and wilfully, did erect and cause and procure to be erected in and across said public road and upon his said land a certain fence, and unlawfully and willfully did recontinue said fence, so erected as aforesaid to continue and remain therein for a period of three hundred and sixty five days next before the time of finding this Indictment, against the peace and dignity of the Commonwealth of Kentucky

This day came the parties by their attornies, and thereupon came a Jury towit George W. Marshall, George H. B. Thompson, Thomas Perkins, James H. Murray, John H. Smarr, Jonathan Hedgecock, James Bradford, John Murray, John R. Linville, Samuel L. Marshall, John Perkins, and Daniel Byars, who being elected tried and sworn well and truely to try the issue joined, upon their oaths do say "We the Jury find the road obstructed ^by fence^ one hundred and four days

Therefore it is adjudged by the Court that the plaintiff recover of the Deft One hundred and four dollars, the fine imposed by law, agreeable to the finding of the Jury in their verdict aforesaid, and also her cost herein expended.
