Luther D Jones Deft

This day came the accused, together with Robert L Jones by his attorney in fact Nat Gaither, (who herewith files the power of attorney from Robert L Jones to himself) And also Nat Gaither and acknowledged themselves indebted to the Commonwealth in the sum of Six hundred dollars, that is to say the said Luther Jones in the sum of Three hundred dollars, and the said Robert L Jones & Nat Gaither in the like sum of Three hundred dollars, but upon condition and to be void, should the said Luther Jones personally appear in this Court upon the first day of the next term, and surrender himself into custody to answer an indictment for felony, and not to depart without leave of the Court. —.

And at a Court continued and held as afsd on the 6^th day of May 1861 — The defendant being solemnly called to appear in discharge
of the recognizance entered into by him in this Court upon the 11^th day of March 1861, came not but made default, It is therefore condidered by the Court that the Clerk of this Court issue a writ of scirefacias against the said defendant, together with Robert L Jones and Nathaniel Gaither his bail, to shew cause if any they have or can why the Commonwealth shall not have Judgment against them for the sum of Six hundred dollars; that is to say the said defendant in the sum of Three hundred dollars and the said Robert L Jones & Nat Gaither in the like sum of Three hundred dollars, according to the form and effect of said recognizance, and for a breach of the condition thereof, And on motion of the Commonwealth, It is ordered this case be continued and a capias is awarded her herein
