To his excellency Beriah Mcgoffin
Gov — of the Commonwealth of Kentucky,

The petition of A, R, Barton respectfully shoeth shoeth unto your Excellency That at the presant term of of the Whitly Circuit Court he was was fined in the sum of $40 00 upon an indictment for gameing petitioner never did gamble in ^his^ life and never expects to, he states that he played at a game for amusement in which the game was Kept by five cent peace's & the witness saw the money up & thought the same was bet when in truth & infact your petitioner did not win or loose one cent and never did ~~win~~ bet the money or know & does not now know that any person ^bet^ ~~believe~~ on the game at which he played he states that he never would gamble & that he hates & has always hated the practice wherefore your petitioner prays your excellency to remit said fine

We the undersigned state that we are will acquainted with Dr A, R, Barton & certify with pleasure that he never has been a gambler but on the contrary opposed to gambling bitterly but the
Dr will play for amusement only

Wherefore we being well acquainted with the foregoing facts pray to be heard in behalf of Dr A, R, Barton that your excellency may remit said fine

I have heard numbers of good citizens affirm the truth of the facts set forth in the foregoing petition & the Dr says he is no gambler & he is a high minded hon. man and his word is sufficient authority to me to say to your excellency that he did not gamble on the occasion for which he was fined & that he no gambler
