The Grand jury of Washington County in the name and by the authority of the Commonwealth of Kentucky accuse Thomas Chesire, William Chesire and Daniel Hardin of the crime of malicous wounding committed as follows The said Thomas Chesire William Chesire and Daniel Harden on the 13 day of August 1860 in the county aforesaid did wilfully and malicously cut thrust and stab one Jno W Hendricks with a knife which was a deadly weapon with intent to kill said Jno Hendricks so that he died not thereby against the peace and dignity of The Commonwealth of Kentucky

The parties appeared whereupon the following juror^s viz, E B Miller Thomas Coulter, Harrison Raybourn Theodore Spalding, Thomas J Montgomery Pat Lydam R Y M^cElroy Archer M^cKenna, Jno J Barker, Steth Thompson James Edelen, D B Hughes were sworn to well and truly try the issue joined and having heard the evidence rendered the following verdict.

"We of the jury find the defender Thomas Chesire not guilty of the offence of malicous wounding charged on the within indictment but we find him guilty being present aiding assisting in the wounding in sudden heat and passion and in consequence thereof do fix his punishment at a fine of fifty dollars and Six months imprisonment in the county jail --

Wherefore it is adjudged that the plaintiff recover of the defendant the sum of fifty dollars and the cost of this prosecutor and that the defendant be confined in the jail of Washington County jail for the period of Six months and when said period of confinement shall have terminated the defendant shall be retained in confinement
until the fine is paid but the period of confinment shall not exceed one day for ~~everey~~ each two dollars of the fine --
