Hon Beriah Magoffin, Gov of the Commonwealth of Kentucky

We your humble petitioners would represent to your honor that at the May Term of the Owsley Circuit Court ^1861^ that James E Sloan, was tried, and found guilty of carrying concealed a Pistol, contrary to the statutes of this State, We would further represent to your honor ^that we believe^ that the said James E Sloan, had no intention of concealing said Pistol, and does not believe the same was concealed from ordinary observation. and that if he had had his own witness present, he could have proved that said Pistol was not concealed, We woul further represent to your Excellency that said Sloan is a poor man, and gains his livelihood by his daily labor, and that it would be a great hardship for him to pay the fine, (which is $50,) and that he is a fit subject for the clemency of the Executive and in duty bound we will ever pray

The affiant James E Sloan states the he did have the Pistol, as charged in the indictment, but said ~~con~~ Pistol was not concealed from ordinary observation, And if any time it was concealed, it was not his intention to conceal it, But he at all times attempted to keep the same in plain view, in the outside Breast pocket of his Coat,
