To his Excellency Gov Magoffin:

The undersigned would state that Washington Cunningham & Lewis Wheeler were guilty of a breach of the peace, by fighting together, on or about the 17^th of April 1861, that on the 12^th of same month Washington Cunningham was tried for the offence and fined there for $11 ⁴⁵/₁₀₀~~which~~ and costs; that the fine was replevied before Jas. T. Smith, a Justice of the Peace for Harrison County, by William Cunningham, on the same day, the repleivin bond amounting to $15 ⁵⁵/₁₀₀, that William Cunningham replevied the fine & cost aforesaid for Washington Cunningham, upon the promise of the latter that he would work for the former until his labor would pay the repleavin bond, when William would discharge it; that Washington has abandoned the service of William & refuses to perform the labor he promises to do; that Washington has no property and that the replevin bond must be paid if at all by William Cunningham, who is a poor man dependent upon his daily labor for a support for himself & family. We would state that the guilty will not be punished, but the innocnet, if William Cunningham is compelled to pay the replevn bond. We therefore pray your Excellency to remit all the fine except the officers fees and as in duty bound will ever pray,
