To his excellency B Magoffin Governor of Ky

Your petitioner Jno H Kemper, would respectfully represent that he was fined before James T Ford Esq on the 9 day of July 1861. on a warrant for keeping a tipling house the sum of $20 -- ^for retailing^ He further represents that he was innocent of the charge and the same could only be proved against him by irresponsable witnesses who were greatly prejudiced against him. He also states that the whole affair was conceived and carried out by the prosecutor and witnesses against him altogether through mallice, ^A remission of the fine is respectfully asked,^. He positively alledges that he is innocent of the charge, this 25th Aug 1861,

I was attorney for Mr Kemper in the above cause and from the facts and ~~the~~ circumstances Surrounding the same I am satisfied that Mr Kemper is innocent of having violated the Law and I really believe the fine ought to be remitted

I attended to the prosecution for the commonwealth against Mr Kemper & was so well satisfied from the manner of the prosecuters & witneeses ^that^ Mr Kemper ought not to suffer the penalties of the law I released the 30 percent due me as county attorney & I sincerly hope your excellency will remit the fine as I believe in Justice it ought to be done

I was the Justice who tried Mr Kemper on the within charge and I give it as my opinion, that the whole affair was carried on through prejudis. In fact from what I could see mallice was only element in the case. 25th Aug 1861
