Governor of the State of — kentucky I acted as Commonwealths attorny in the circut court of Pendleton county, at the time of the trial and conviction of David Boner & Joseph Hendrix the Evidence was that they were in Company of Some Drinking men and got towo much aborad themselfves & while under the influence of Drink they went into the Storehouse of Thos Wheeler and took therefrom Some Boxes of Gun Caps, Some bares oil & other things of Small value the Jury found them guilty & Sent them to the State prision for one year each Boath Boner & Hendrix are of as god family as we have in this county and they have ^borne^ good ~~conexion~~ Characters heretofore & there is Strong Reasons for belieiving that had they been Sober they would not have been guilty of the act and in as much as near all the Jury has Signed a Petition for their Pardon & I do not think they did the act for the purpose of theft. but as a Spree and their Extreem youth, not being over 17 years old I therefore Joine the prayer of the petition for their
