To his Exelency Berah Magoffin, Govenor of the Commonwealth of Kentucky

Your petitioner Thornton Suttles says that at the February Term of the Rockcastle Circuit Court 1862 A Judgement was rendered agst him for $60 — & cost ^in favor of the commonwealth^ for keeping a Tipling house in said county —

Now your humble petitioner states that it is wrong & unjust for him to pay said Judgement. because he says that in the fall of 1861 at this time the united states troops were encampt at Wild Cat in Laurel cty some two miles from his house he was persuaded by some sick soldiers & those having them in charge to buy a barrrel of brandy & sell to them as medison as they were unable to get any in the vacenity of that section of country, he says with a good intent & not otherwise he purchased a barrel of brandy & paid high for it, for the benefit of said sick soldiers, He says that shortly after he purchased said brandy & before he had sold one half of it to said soldiers ^or other persons^ The army at Wild Cat was orderd back in ^to^ the interior of the state, & as they passed by his house, not withstanding the kind treatment he had bestowed toward them in every way he could (to secure his little chance of property from their roguish hands.) they came into his house & by force took more than half of his brandy & never paid him a cent in the meantime with their weapons of war waving over his head, these he says thus treated him & for selling what he did sell to them & to others who were wet & cold & sickly he was indicted & Judgement went against him as afs^d. He states that he is a very poor man with 13. in family whites & no slaves & none of his children except two are able to labor for him for his & their support He says he cant pay the fine & if not remitted by your Exelency he will have to go to Jail & share the fate of a poor unfortunate humble citizin Wherfore he prays a remitance of the fine & hopes your Exelency will hear his prayer

I believe the statements in the foregoing petition are true, I know the petitioner is a poor man, but honest and has a large family, and the fine ought to be remitted.
