To his Excellency B. Magoffin &c

Your Petitioner Benjamin Ferguson would State to your excellency that at at the Oct^o Term 1858 of the Clinton Circuit Court he with others were Indicted in two Cases for Gaming on premises not his own, and at the April Term 1859 of Said Court the Indictments were dismissed as to the other Defendants, and Judgment rendered in One Case against your Petitioner for $5 atto fee & costs and in the other for $20. fine $5 atto fee & costs. Your Petitioner would represent to your honor that on the [ ] day of [ ] 18[ ] Capias issued upon said Judgments, and that on the 1st day of June 1861. he together with Brooks Owens his Surety replevied said Judgments — and that one of said Judgts amounts to $33.96 and the other to the Sum of $13.50 — Your Petitioner states that he is a poor man, and oweing to the unprecedented hardness of the times does not know how he is to pay off said Judgments, that if Executions issued upon said Judgments and his property or his suretys has to sell it will be Sacrifised as property is going for almost nothing — Your Petitioner asks you to remit the Judgment for $20 ^or what amount you can by law^ going to the State — Your petitioner has a family to Support And hopes your Generosity will prompt you to remit the fine aforesaid — hopeing thereby to save some of his said Sureties property —
