To his excellency The Governor of the Commonwealth of Kentucky your petetioner will State that one Jacob Sike was recognized for his appearances in the Union Circuit to answer an Indictment for petty larciny at the October term 1860 and your petitioner became his surity — that after the grand Jury forced a bill against Sike for said offenses the judge of s^d court issued a bench warrant for the arrest of said Sike which went into the hands of an authorized deputy sheriff of this County and your petitioner went with said deputy to the house of said Sike, and took said Sike into custody. and before the officer got Sike to town he made his escape & has never been recaptured.

That said recognizance has been taken for forfeited against your petitioner and a judgment of said court has been rendered thereon against your petitioner for $250 and an execution is now in the Sheriffs hand, against your petitoner and he will proceede to collect the same unless stoped by the timely interposition of your Excellency.

Your petitioner will state that said Sike was by his aid to the officer placed in the custody of of the law, and if, the officer suffered him to escape, this petitioner ought not to be held responsible for the mishap of the officer he has heretofore addressed a petition to your excellency on this subject through the agency of the Honorable Ben P Cissell which is now on file in the secretary^s office & is now here referred to — and as a Judgment is now rendered your excellency can act, he prays a remission of said fine & for all other relief

I am familiar with the facts stated in this petition and know they are true and fully endorse the statement of W G Hughes herein and feel confident it appeals for executive Clemency and ask your excelency in his behalf for such action as the facts now justify

we the undersigned citizens of Union County will state to the Governor of Ky that we are well acquainted with the petitioner James Waggoner, he is a very poore man but a good citizen, and we believe the statement made in this petition are true and pray your excellency to remit his fine inflicted and in duty bound they will ever pray

I was Atty for the Commonwealth at the time the Judgt was rendered on the within forfeited Recognizance and think you ought to remit that portion of Judgt to which the Comlth is intitled — Waggoner is a poor man and a good Citizen and to pay that amt would now break him nearly up and leave his family almost pennyless
